2. Applicability
These terms and conditions apply to all offers, orders, and agreements concluded via the website of Mon Chemin Bath Products B.V. By placing an order, the customer agrees to these terms.
2a. International Orders – Customers Outside the European Union
Mon Chemin Bath Products B.V. is a Dutch company. All our products are developed and manufactured in the Netherlands in compliance with the strict safety and quality regulations of the European Union (EU Regulation 1223/2009 on cosmetic products). Customers placing orders from countries outside the European Union are solely responsible for complying with the import, use, and possession regulations of Mon Chemin products in accordance with the cosmetic, labeling, customs, and consumer protection laws applicable in their own country.
By completing your purchase, you confirm that:
• You are purchasing for personal use only
• You understand and accept that Mon Chemin products are not specifically registered or approved under the laws of your country, unless explicitly stated otherwise
• You assume full responsibility for compliance with any import duties, local taxes, customs procedures, or cosmetic regulations
Mon Chemin Bath Products B.V. cannot be held liable for delays, refusals, confiscations, or fines that may result from local import restrictions or legal requirements in the destination country. We recommend contacting local authorities if you are unsure whether cosmetic products from the EU may be imported for personal use in your country.
3. Products
We strive to present our products as accurately as possible. However, due to natural variations in ingredients and screen settings, colors and fragrances may vary slightly. All products are subject to availability.
4. Prices and Payment
All prices are stated in euros and include VAT. Payment must be made in full prior to shipment using the payment methods offered on our website.
5. Shipping and Delivery
Orders are processed and shipped within the timeframe stated on the product page. We are not responsible for delays caused by third parties. Shipping costs are clearly displayed during the checkout process.
6. Right of Withdrawal (Returns)
Customers have the right to cancel their purchase within 14 days of receipt without stating a reason. Returns are only accepted under the following conditions:
• The product is unopened, unused, and in its original, saleable condition
• Return requests must be submitted within 14 days via info@mon-chemin.com
• Return shipping costs are borne by the customer
• Refunds are processed within 14 days after receipt and inspection of the returned product
We reserve the right to refuse returns that do not meet the above criteria or show signs of use or tampering.
7. Exclusions from Returns
The following items are excluded from return or refund:
• Opened or used products
• Free items or samples
• Gift cards
8. Warranty and Liability
Our products contain high quality oils and refined fragrances. Although we use carefully selected ingredients, individual allergic reactions or skin sensitivities may occur. We recommend testing a small amount before full use. Mon Chemin Bath Products B.V. is not liable for adverse skin reactions, allergies, or improper use. We are not liable for indirect, consequential, or incidental damages, including but not limited to loss of profit, data loss, business damage, or reputational damage, except in cases of intent or gross negligence. Our total liability shall never exceed the amount paid for the product in question.
9. Intellectual Property
All content on www.mon-chemin.com, including branding, texts, images, logos, and packaging designs, is the exclusive property of Mon Chemin Bath Products B.V. and may not be copied, used, or distributed without our written consent.
10. Privacy
We respect your privacy. Personal data is processed in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR).
11. Complaints and Disputes
Complaints can be submitted by email to info@mon-chemin.com. We aim to respond within five working days. All agreements and disputes are governed by Dutch law. Disputes shall be submitted exclusively to the District Court of Rotterdam, The Netherlands, unless mandatory law provides otherwise. For international customers, local consumer law may apply if it offers stronger protection.
12. Force Majeure
We are not liable for failure to fulfill obligations due to force majeure, including but not limited to natural disasters, war, strikes, governmental measures, transport disruptions, or failures of third party suppliers.
13. Amendments
We reserve the right to amend these terms and conditions at any time. The version applicable is the one in force at the time the order is placed.
